Glenn Banner has been convicted of Aggravated Battery with a Deadly Weapon on a Person 65 Years of Age or Older. A jury returned the guilty verdict this afternoon, following a two-day trial in Lee County.
Assistant State Attorney Thomas Guthrie prosecuted the case.
On August 12, 2023, the Lee County Sheriff’s Office responded to a disturbance call at a home in North Fort Myers. Deputies found the defendant standing in the street with minor lacerations to his face. He said he got into a fight.
Deputies then interviewed the victim, who had a laceration to his head and numerous lacerations to his face. He explained he had been in a bedroom when he heard the generator outside turn off. The generator was used for another resident’s oxygen machine as the electric was out.
The victim went outside to ask the defendant to turn it back on and a fight ensued. The defendant refused to turn it back on and punched the victim, then grabbed a small wooden bat and hit him with that too.
The victim was able to get away and get back inside the house to contact law enforcement.
Sentencing is scheduled for September 10, 2024.
