Maximum Sentence in Resisting and Possession Case

Jophery Donell Mccoy was sentenced to the maximum of 5 years in prison, by the Honorable Judge Bruce Kyle, immediately after being convicted of Resisting or Obstructing an Officer without Violence, Possession of a Controlled Substance, and Driving While License Suspended or Revoked with Knowledge.

The jury returned the guilty verdict just before 6 p.m. Wednesday night, following a one-day trial in Lee County. Assistant State Attorneys Kathryn Lavelle and Christine Cummins prosecuted the case.

The crime happened on June 2, 2025. Deputies with the Lee County Sheriff’s Office attempted a traffic stop of an SUV on Tice Street due to a defective taillight. The driver did no stop but continued driving at a low rate of speed. The driver then came to a stop and threw open the driver’s side door and took off running.

He refused orders to stop and ran into a backyard. He was found hiding under a mobile home and taken into custody. The suspect’s identity was confirmed as that of the defendant and he was driving on a suspended license. Under the mobile home where the suspect was hiding were three baggies, one of which tested positive for Substituted Cathinones.
