Prison Sentence for Possession of Fentanyl and Meth

Adam James Perlberg, arrested following an undercover drug operation in Lee County last year, was sentenced to 84 months in prison for two counts of Possession of a Controlled Substance (Fentanyl and methamphetamine). He was sentenced to credit time served, over a year, for two counts of Possession of Paraphernalia, the maximum sentence for those counts.

Assistant State Attorney Marilla Shoemaker prosecuted the case. The defendant was convicted following a trial in May.

The defendant was arrested by the Lee County Sheriff’s Office Narcotics Unit. As part of their undercover operation, they got a search warrant for a motel room in North Fort Myers where the defendant was staying. Inside the room methamphetamine was found in a safe and drug paraphernalia was scattered around the room.

The defendant was detained and searched. Small baggies of Fentanyl were found in the defendant’s pockets. He was then arrested.

This case violated the defendant’s probation in another case. The defendant pled straight to the court on the Violation of Probation (VOP) charge after being convicted at trial in this case. This is not a plea agreement. A defendant may choose to plea straight to the court for sentencing.

On the VOP, the defendant was sentenced to a concurrent 84 months in prison for Possession of a Firearm by a Convicted Felon and Possession of a Controlled Substance.
