Jonathan Mariotti was found guilty of Grand Theft, a first degree felony, following a trial in Lee
County. The evidence showed the defendant stole more than $185,000 while he was the
treasurer of a homeowners association. The jury deliberated for less than an hour before
returning the guilty verdict late Friday.
The Lee County Sheriff’s Office initially investigated the case after getting a complaint of theft
by the president of the homeowners association. It was discovered that from January 2014 until
April 2017, Mariotti transferred $185,880.59 from the two accounts belonging to the association,
to his business account.
The funds were used to pay for equipment, parts, and salaries for employees of the defendant’s
elevator company. The money was removed through the use of 40 direct transfers. When the
defendant’s business was making money, he made 13 direct transfers to move $142,421.60 back
into the association’s accounts. The loss to the association as of April 28, 2017 was $43,458.99.
Mariotti had been on the association for ten years.
Assistant State Attorney Tino Cimato of the State Attorney’s Office Economic Crimes Unit
prosecuted the case. Mariotti was remanded into custody after the verdict was read. Sentencing is
scheduled for March 30th.
