Augustin Tellez Tapia has been found guilty as charged with Battery on a Person 65 or Older, following a one-day trial in Collier County.
Assistant State Attorney Jose Cabrera prosecuted the case.
On March 25, 2024, the Collier County Sheriff’s Office responded to the Immokalee Produce Market in reference to a battery.
The defendant sells produce at the market and approached a man, accusing him of taking wood pallets he had rented, to display his produce.
The victim had what he believed to be pallets that were available from the market and began to walk towards a management office to resolve the situation. The defendant followed and kept arguing then, without warning, punched the victim in the face.
The incident was captured on surveillance video from the market and the defendant was arrested.
Sentencing is scheduled for October 9, 2024.
