Grand Jury Indictment

State Attorney Amira Fox convened the Lee County Grand Jury, and they have returned an indictment against Joseph Henry Roberts, of Fort Myers, on the following:

Count I. First Degree Murder – Unlawful Distribution of Fentanyl F.S. 782.04 (1)(a)3g Capital Felony

Count II. Sale or Delivery of a Controlled Substance F.S. 893.13 (1)(a)1 Second Degree Felony

The indictment reads in part that on, about, or between October 4th and 5th, 2025, a Lee County resident, died after being given Fentanyl, which caused, or was a substantial factor, in her death.

“I want to thank the Fort Myers Police Department for their investigation which led to this case being able to be presented to the Grand Jury. The Lee County Grand Jury is to be commended for their focus during the presentment of the unsettling details of this case,” said State Attorney Fox.

“We will continue to seek the maximum charges allowed by law, First Degree Murder, if deadly drugs like Fentanyl are dealt in Southwest Florida and they lead to death,” said State Attorney Fox.
