Guilty as Charged in Battery Case

Nandy Alexander Fernandez, 33, of Cape Coral, was found guilty as charged of Child Abuse, Battery on a Person 65 Years of Age or Older, Resisting an Officer Without Violence, Threat to Do Serious Bodily Harm to a Public Official, and Criminal Mischief. The jury returned the guilty verdict following a one-day trial in Fort Myers.

On April 14, 2021, the Cape Coral Police Department was called to the scene of a fight at a home in the Southwest Cape. Upon arrival, the defendant was actively screaming at, and trying to batter, a male victim. The defendant did not stop trying to go after the victim even though officers were on scene.

Ultimately Fernandez was taken into custody. While in the patrol car on the way to jail, he attempted to kick a window out and was further restrained.

Assistant State Attorney Erin Hughes prosecuted the case. Sentencing is scheduled for April 26th.
