Guilty Verdict in Attempted Murder Case

Sentencing has been set for August 15, 2022, for defendant Bacilio Antemate Xolo, 43, of Fort Myers. He was found guilty as charged of Attempted Second Degree Murder and four counts of Child Abuse, following a trial in Lee County.

The crime happened on November 4, 2019. The Lee County Sheriff’s Office responded to an apartment complex after getting reports of a shooting. Upon arrival they met the victim, a woman, who had sustained a gunshot wound to the face. She was standing outside of an apartment with several children.

As deputies were gathering information, witnesses pointed to the defendant, and said he did it. Xolo, who was nearby, had blood on his shoes. As he was being detained, he attempted to pull away from the deputies.

The defendant made a statement to detectives that he had been arguing with the victim prior to the shooting. He then shot her in the cheek, in front of the children. He told detectives he then threw the gun in the water. Divers with the Lee County Sheriff’s Office were able to retrieve the weapon from the pond behind the apartment complex.

Assistant State Attorney Lindsay Scott Garza and Assistant State Attorney Leena Marcos prosecuted the case.
