Guilty Verdict in Vehicular Homicide Case

Justine Marie Fagan has been found guilty as charged of Vehicular Homicide, following a trial in Collier County.

On January 27, 2022, the defendant killed a woman, after speeding through traffic on Everglades Boulevard North going northbound in the southbound lanes. The victim was attempting to make a left turn onto Everglades Boulevard North when the defendant collided with the driver’s side of the victim’s vehicle.

The speed limit on the road is 45 mph but the Event Data Recorder shows the defendant was driving as much as 87 mph, seconds before the crash. The Florida Highway Patrol Traffic Homicide Unit began an investigation.

Witnesses stated that the defendant had been driving recklessly leading up to the crash. The defendant was positively identified as the driver and was arrested following the investigation.

Assistant State Attorneys Mara Marzano and Lawrence Raab prosecuted the case.

Sentencing is scheduled for March 14, 2024.
