Today David Martin Rodriguez was sentenced to 10 years in prison followed by 5 years of probation for one count of Robbery with a Firearm as a Habitual Felony Offender.
In February of this year, the defendant robbed a 7-11 convenience store in Fort Myers, across the street from the apartment he was living in with his girlfriend. He was wearing a wig with a hoodie sweatshirt, attempting to conceal his face and identity. The employees of the store still recognized the defendant because he was a frequent customer and they saw his facial tattoos. He pulled out a gun, stole money and ran back across the street.
Minutes after the robbery, a woman living in the same apartment complex as the defendant called law enforcement about someone possibly trying to break into her apartment. A man was banging on her door screaming for her to open it. She thought it was the man who lived in the apartment next to her. Deputies with the Lee County Sheriff’s Office on their way to the scene of the robbery, quickly responded, and detained the man. It was the defendant, Rodriguez.
In his apartment deputies found many wigs, including one similar to the one the defendant was wearing during the robbery. All of the wigs were packaged except the wig that appeared to be the one from the robbery. It was laying in a basket in a closet. Deputies also found the hoodie sweatshirt and cash.
Assistant State Attorney Christine Cummins prosecuted the case.
