Officer Involved Shooting Review Complete

Fort Myers (May 16, 2024) – The State Attorney’s Office announced today that Fort Myers Police Department Detective James Moschella would not face criminal charges for the shooting death of Christopher Jordan, during an incident on December 1, 2023, at 3222 Stella Street in Fort Myers.

Fort Myers Police responded to that address after Cynthia Jordan, Christopher Jordan’s sister, called 911 at 8:19 p.m. to say that he had threatened to kill her with a gun.  Cynthia Jordan confirmed that numerous times during that night and under oath. Detective Moschella indicated that he observed Christopher Jordan raise a firearm towards an open window. Given the circumstances, Detective Moschella fired his patrol rifle one time, striking Christopher Jordan.  After life saving measures failed, Christopher Jordan was pronounced dead at Lee Memorial Hospital at 9:49 p.m.

The Florida Department of Law Enforcement investigated the incident.  It provided to the State Attorney’s Office an Investigative Summary and supporting evidence, which included the 911 call, computer-aided dispatch (CAD) notes, radio logs, body-worn camera footage, interviews, crime scene photographs and other reports.  Additional investigative interviews were conducted by State Attorney’s Office Investigators.

“I want to stress, any loss of life, is a tragedy. It is never the way anyone wants to see a situation end. When an on-duty officer is involved, it becomes the responsibility of my office to review the totality of the evidence, everything that took place, from the initial contact with law enforcement, to the actual encounter, and what led to the use of force. Such reviews are complex and extremely detailed. I want to thank the community for its patience in this matter as we worked to review all of the evidence in this case,” said State Attorney Amira Fox.
