Prison Sentence for Crimes Against a Child

Gary Fontaine Evans, 43, of Fort Myers, was adjudicated guilty and sentenced, for crimes against a child. He was also designated a Sex Offender.

He was sentenced to 15 years in prison, on each of two counts, of Lewd and Lascivious Battery. He was sentenced as a Prison Releasee Reoffender.

He was sentenced to 18 years in prison, on each of three counts, of Promoting a Sexual Performance by a Child. He was sentenced as a Habitual Felony Offender.

He was sentenced to 5 years in prison, on each of three counts, of Possession of Child Pornography.

All counts are to run concurrent. He must also pay court costs, the cost of prosecution, and pay a fine to the Rape Crisis Fund. Evans pled guilty to the charges.

On February 7, 2021, the Lee County Sheriff’s Office responded to a Fort Myers motel in reference to a sex crime. A juvenile, who had been reported missing, was located in a room with the defendant.  The investigation revealed the defendant had been giving the child cocaine and having sexual intercourse with her, in the motel.

Assistant State Attorney Christine Cummins, of the Special Victims Unit, prosecuted the case.
