Prison Sentence in Economic Fraud Case

Scott Louis Kish, of Naples, was sentenced to 10 years in prison, followed by 5 years of probation, for Theft and 10 years in prison, followed by 10 years of probation, for Misapplication of Construction Funds. The sentences are to run concurrent.

The defendant was convicted in March following a jury trial in Lee County. Economic Crimes Unit Chief Assistant State Attorney J.D. Miller prosecuted the case.

The defendant was doing business as “KTS Homes LLC” in Lee County. The victim hired the defendant to do remodeling on a newly purchased home in Bonita Springs. Between November 2018 and April 2020, the defendant was paid $1,346,000 via checks and bank draws for the full completion of the project.

The defendant failed to pay numerous subcontractors, despite being given the money to do so, causing numerous liens to be placed on the victim’s property. The subcontractors walking off the job caused extensive damage because work was incomplete. There were no windows put in so there was extensive water damage. The defendant would tell the subcontractors he had not been paid for the job when he had.

The evidence showed the money paid, was billed as actual expenses plus a profit. More than half of it was spent on other projects and the defendant’s personal life. The defendant also misled the victims into believing he was also a licensed architect as part of the original contract.

The Lee County Sheriff’s Office investigated the case.
