Life in Prison for Attempted Murder

Bacilio Antemate Xolo, 43, of Fort Myers, was sentenced to life in prison for Attempted Second Degree Murder and 5 years in prison, the maximum, on each of four counts of Child Abuse. The charges are to run concurrently. He was found guilty in July, following a trial in Lee County.

The crime happened on November 4, 2019. The Lee County Sheriff’s Office responded to an apartment complex after getting reports of a shooting. Upon arrival they met the victim, a woman, who
had sustained a gunshot wound to the face. She was standing outside of an apartment with several children.

As deputies were gathering information, witnesses pointed to the defendant, and said he did it. Xolo, who was nearby, had blood on his shoes. As he was being detained, he attempted to pull away from the deputies.

The defendant made a statement to detectives that he had been arguing with the victim prior to the shooting. He then shot her in the cheek, in front of the children. He told detectives he then threw the gun in the water. Divers with the Lee County Sheriff’s Office were able to retrieve the weapon from the pond, behind the apartment complex.

Assistant State Attorney Leena Marcos and Assistant State Attorney Lindsay Scott Garza prosecuted the case.
