Sentencing in Murder Case

Gabriel Fernandez was adjudicated guilty and sentenced to 40 years in prison for Second Degree Murder and 15 years in prison for Shooting in a Dwelling. The
sentences are to run concurrent.

In September 2022, the defendant was arguing with another person inside a residence in Cape Coral. The victim, who was also in the home, attempted to intervene. The defendant pulled out a gun and fired one shot, hitting the victim. As the victim left the room, the defendant fired a second shot, killing the victim.

The Cape Coral Police Department handled the investigation.

Assistant State Attorney Andreas Gardiner, of the State Attorney’s Office Homicide Unit, prosecuted the case.
