Capital Sexual Battery Conviction

Brian Author Thomas, 28, was found guilty as charged of Capital Sexual Battery, Lewd or Lascivious Molestation on a Child under 12, Video Voyeurism on a Child under 16, and Battery on a Child by Contact with Bodily Fluids following a four day trial in Charlotte County. He faces life in prison at his sentencing on April 23rd.

Between January 2014 and March 2016, Thomas resided with the victim’s family in Port Charlotte. During this time, he took videos of the victim and inappropriately touched her while she was asleep. The abuse began when the victim was 9 years old and continued over the 2 year period that he lived in the home.

Evidence in the case included videos taken by Thomas. He videotaped himself committing the acts on the child and also recorded videos of the victim taking a shower by hiding his cellphone in the bathroom with towels and other objects. 

Assistant State Attorneys Stephanie Powers and Kyle Stublen prosecuted the case.
