A scooter crash caused by drunk driving lands a man in jail for almost one year. Edward Ray Shambaugh was found guilty as charged by a Lee County jury with Driving under the Influence (2nd or more)(.15 or higher) and Driving While License Suspended or Revoked.
This was Shambaugh’s fifth DUI and stemmed from an incident that occurred in December 2016, when he crashed his scooter into a median in Lehigh Acres, with the scooter landing on top of him. His blood alcohol level was determined to be more than three times the legal limit. The other four DUI’s were in Broward County.
On his first count, he received the maximum penalty for his charges with 364 days in jail. He was also sentenced to 12 months of probation and had his driver’s license permanently suspended. He may not possess or consume any alcohol and will undergo random screens. Shambaugh must also complete the Residential Substance Abuse Treatment program, attend DUI school and pay a $4,000 fine plus court costs.
As to the Driving While License Suspended or Revoked, he was sentenced to serve 60 days in the Lee County Jail to run consecutive to the first count. Assistant State Attorneys Jennifer Justham and Amanda Astor handled the case.
